You May Be Entitled to Pay for All of Your On-Call Hours 

Many “on call” employees work full shifts on site and are then required to remain on call for hours afterward or over the weekend, yet they often receive no pay for that on call time unless they are actually called back to work. Failing to compensate employees for all hours spent on call, whether or not they are summoned to work, may violate federal and state wage laws.

 

For example, Sares Regis Group, a large real estate development and property management company, requires its maintenance staff to remain on call, respond within minutes, and arrive promptly at the job site when called in. Yet maintenance employees report not being paid for that standby time. The law requires employers to pay for on call time when their restrictions prevent employees from using that time freely. This can include requiring workers to stay nearby, respond within minutes, remain sober, or avoid normal personal activities, like going out to eat, exercising, or socializing, because they must be ready to return to work quickly.
